Many people have self-control problems. So scientists test to see how much self-control people have. In Some countries doctors test children and see if they'll give into temptation by using the five senses. Doctors use the most common test called the Marshmallow test. This test was done in the 1960's, this test illustrates the war between impulsivity and self-control. The children who are the test objects are sat in a room and the doctor sits them in a chair and the doctor tells them they can wait to eat the marshmallow or they can eat it now. If they choose to wait 15 minutes they earn another marshmallow. This test shows children between what they're desires are and focusing on their longer term goals. Children who can reach this goal tend to have better lifestyles. These children end up having higher SAT scores, higher levels of education, better social skills, lowers drug use, fewer relationship problems, and less stress. This helps increase the likelihood of a certain behavior that will occur by reinforcing the behaviors. Emily Dickinson Biography Emily Dickinson was born in Amherst, Massachusetts. Her father and mother were both what we would today call distant. Her brother, Austin, was bossy but ineffective; her sister, Lavinia, never married, and lived with Emily and was protective of the much shyer Emily. Emily at School While signs of her introspective and introverted nature were apparent early, she traveled from home to attend Mount Holyoke Female Seminary, an institution of higher education founded by Mary Lyons. Lyons was a pioneer in womens education, and envisioned Mount Holyoke as training young women for active roles in life. She saw that many women could be trained as missionary teachers, especially to bring the Christian message to American Indians. A religious crisis seems to have been behind young Emilys decision to leave Mount Holyoke after a year, as she found herself unable to fully accept the religious orientation of those at the school. But beyond religious differences, Emily also apparently found the social life at Mount Holyoke difficult. Withdrawn Into Writing Emily Dickinson returned home to Amherst. She traveled a few times after that once, notably, to Washington, DC, with her father during a term he served in the U.S. Congress. But gradually, she withdrew into her writing and her home, and became reclusive. She began to wear dresses exclusively in white. In her later years, she did not leave her homes property, living in her home and garden. Her writing did include letters to many friends, and while she became more eccentric about visitors and correspondence as she aged, she had many visitors: women like Helen Hunt Jackson, a popular writer of the time, among them. She shared letters with friends and family, even those who lived nearby and could visit easily. Emily Dickinsons Relationships From the evidence, Emily Dickinson fell in love with several men over time, though apparently never even considered marriage. Her close friend, Susan Huntington, later married Emilys brother Austin, and Susan and Austin Dickinson moved to a home next door. Emily and Susan exchanged ardent and passionate letters over many years; scholars are divided today on the nature of the relationship. (Some say that the passionate language between women was simply an acceptable norm between friends in the nineteenth and early twentieth centuries; others find evidence that the Emily/Susan friendship was a lesbian relationship. I find the evidence ambiguous at best.) Mabel Loomis Todd, a descendent of John and Priscilla Alden of Plymouth colony, moved to Amherst in 1881 when her astronomer husband, David Peck Todd, was appointed to the faculty of Amherst College. Mabel was twenty-five at the time. Both the Todds became friends of Austin and Susan in fact, Austin and Mabel had an affair. Through Susan and Austin, Mabel met Lavinia and Emily. Met Emily is not exactly the right description: they never met face-to-face. Mabel Todd read and was impressed by some of Emilys poems, read to her by Susan. Later, Mabel and Emily exchanged some letters, and Emily occasionally invited Mabel to play music for her while Emily observed out of sight. When Emily died in 1886, Lavinia invited Todd to attempt to edit and publish the poems Lavinia had discovered in manuscript form. A Young Contributor and Her Friend The story of Emily Dickinsons poems, with their interesting relationship to womens history, is highlighted by the most fertile period of Emily Dickinsons writing, the early 1860s. A key character in this story is better known in American history for his support of abolition, woman suffrage, and transcendentalist religion: Thomas Wentworth Higginson. Hes also known in history as the commander of a regiment of black troops in the American Civil War; for this accomplishment he proudly used the title Colonel Higginson to the end of his life. He was the minister at the wedding of Lucy Stone and Henry Blackwell, at which he read their statement renouncing any strictures that the law placed on the woman when she married, and stating why Stone would keep her last name rather than assuming Blackwells. Higginson was part of the American literary Renaissance known as the Transcendentalist movement. He was already an recognized writer when he published in 1862, in The Atlantic Monthly, a short notice titled Letter to a Young Contributor. Higginson told the story later (in The Atlantic Monthly, after her death), that on April 16, 1862, he picked up a letter at the post office. My own guess? He expected that her poems would be considered too odd by the general public to be accepted as she wrote them. Editing Emily After Emily Dickinson died, her sister, Lavinia, contacted two friends of Emilys when she discovered the forty fascicles in Emilys rooms: Mabel Loomis Todd and Thomas Wentworth Higginson. First Todd began to work on the editing; then Higginson joined her, persuaded by Lavinia. Together, they reworked the poems for publication. Over some years, they published three volumes of Emily Dickinsons poems. The extensive editing changes they made regularized Emilys odd spellings, word usage, and especially punctuation. Emily Dickinson was, for instance, very fond of dashes. Yet the Todd/Higginson volumes have included few of them. Todd was sole editor of the third volume of poems, but kept to the editing principles theyd worked out together. Higginson and Todd were likely correct in their judgment, that the public could not accept the poems as they were. The daughter of Austin and Susan Dickinson, Martha Dickinson Bianchi, published her own edition of Emily Dickinsons poems in 1914. It remained until the 1950s, when Thomas Johnson un-edited Dickinsons poetry, for the general public to experience her poems more as shed written them, and as her correspondents had received them. When Teresa decided to enter the convent as a vocation, her father at first refused his permission. In 1535, Teresa entered the Carmelite monastery at vila, the Monastery of the Incarnation. She took her vows in 1537, taking the name of Teresa of Jesus. The Carmelite rule required being cloistered, but many monasteries did not enforce the rules strictly. Many of the nuns of Teresas time lived away from the convent, and when at the convent, followed the rules rather loosely. Among the times Teresa left was to nurse her dying father. Reforming the Monasteries Teresa began experiencing visions, in which she received revelations telling her to reform her religious order. When she began this work, she was in her 40s. In 1562 Teresa of Avila founded her own convent. She re-emphasized prayer and poverty, coarse rather than fine materials for clothing, and wearing sandals instead of shoes. Teresa had the support of her confessor and others, but the city objected, claiming that they could not afford to support a convent that enforced a strict poverty rule. Teresa had the help of her sister and her sisters husband in finding a house to begin her new convent. Soon, working with St. John of the Cross and others, she was working to establish the reform throughout the Carmelites. With the support of the head of her order, she began to establish other convents that maintained the orders rule strictly. But she also met opposition. At one point her opposition within the Carmelites tried to get her exiled to the New World. Eventually, Teresas monasteries separated as the Discalced Carmelites (calced referring to the wearing of footwear). Writings of Teresa of Avila Teresa completed her autobiography in 1564, covering her life until 1562. Most of her works, including her Autobiography, were written at the demand of authorities in her order, to demonstrate that she was doing her work of reform for holy reasons. She was under regular investigation by the Inquisition, in part because her grandfather was a Jew. She objected to these assignments, wanting to work instead on the practical founding and managing of convents and the private work of prayer. But it is by those writings that we know her and her theological ideas. She also wrote, over five years, the Way of Perfection, perhaps her best-known writing, completing it in 1566. In it, she gave guidelines for reforming monasteries. Her basic rules required love of God and of fellow Christians, emotional detachment from human relationships for full focus on God, and Christian humility. In 1580, she completed another of her major writings, Castle Interior. This was an explanation of the spiritual journey of the religious life, using the metaphor of a many-roomed castle. Again, the book was widely read by suspicious Inquisitors- and this wide dissemination may have actually helped her writings achieve a wider audience. In 1580, Pope Gregory XIII formally recognized the Discalced Reform order Teresa had begun. In 1582, she completed another book of guidelines for the religious life within the new order, Foundations. In recent times countries like United Kingdom, America, Canada and Ireland have tilted more towards crime control mainly because of the terrorist attacks that shook those nations. Moreover the racial attitude in the police and also in the society has led the crime control to be harsh on the society. The miscarriages that happen maybe due to discriminatory police practices, it may be due to incompetent scientific evidence or the over-reliance of the court on expert testimony. Where mistakes, made by those who have power within the process so this power when abused can have critical consequences. The protection of innocent remains fundamental to the process of justice and for many the sole purpose, it should not be absolute according to Ashworth (1998). The acquittal of guilty persons can also be seen as a miscarriage of justice. The process of justice is one marked by the use of agency and individual discretion, most notably by the police. Both the due process and crime control models allow for that discretion, although the former does seek legislative means for reducing its use and influence. The crime control model relies on presumption of guilt, the recognition that victims should have more rights than the accused, belief that prison and other punishment must be unpleasant in order to work, belief that sentences must be long to protect the public and belief that keeping order on the street is more important than following the letter of the law. The crime control model is about focusing the purpose of the Criminal Justice Process on the demands of the majority of citizens who are law abiding. It seems clear that the current Criminal Justice Process was designed for the much lower level of crime that existed in the past and is too bureaucratic, time consuming and inefficient to deal effectively with the sheer volume of crime that now exists. This system demands a high level of informal fact finding, the case is dealt with outside of the formal court setting as much as possible. The model rightly assumes that offenders â€Å"rights are less important than victim rights and justice is for the majority of law abiding citizens not for the minority of repeat offenders. This model of justice accepts that there will be a few aberrant cases where the innocent are convicted, but this is justified by the notion that crime control overwhelmingly achieves the greater good for the majority. At the international level miscarriage of justice is the subject of norms but its meaning is imprecise. Lord Phillip and Brown presume ‘the man on the street would define ‘miscarriage of justice’ as the conviction of the innocent. It was stated in the Court of Appeal case of Exp. Bateman(1994) that man might define the term more broadly, to include those convicted when they should not have been. In countries the policing the law we see that more power has been vested in the police which is one reason for the crime control model to cause miscarriages of justice. Specially in America after the 9/11 terrorist attack the government has taken measures to prevent crimes as much as possible. The 9/11 attack not only influenced the government but influence the society to look at people an a suspicious way. For example after the 9/11 attack a muslim person, with his beard and his dress code, walks in the street with a bag on his hand or back, people look at him as if he is a terrorist with a bomb. This view of society should change for it is society that subjects the police and the government to undue pressure. In 2005 the terrorist attack in London (7/7) killed 56 people and 700 were injured. This was the largest and deadliest terrorist attack in London in history. It is clear that law enforcement agencies powers have increases with the statutes that have been implemented. The Terrorist Act 200 created a power to carry out blanket stop and searches. The Anti- Terrorism Crime and Security Act 2001 introduced new powers for the Treasury to freeze terrorist funds and control orders on terrorist suspects can be imposed under the Terrorism Act 2005. The Terrorist Act 2006 gives police the power to detain terrorist suspects up to 28 days. Not only the acts gave the police powers but it always helped them misuse it. The Police Reform Act 202 supplements existing police powers which follow the established trend towards broadening powers of law enforcement agencies and diluting the safeguards for the suspect. The ‘war on terror’ is now a common feature of crime prevention and detection in United Kingdom. Police appear to tour the streets in far greater numbers than they did prior to 9/11 and 7/7 attacks. More over there is an issue as to an ethnic minority in the law enforcement agencies. Local communities, where those being policed have felt for some years that powers possessed by the police have become too intrusive and are being used in a discriminatory way to target particular groups within the community. Research has shown that that Black and Asian people are more likely to be stopped under the provisions of the Terrorism Act 2000 than white people. When police powers are increased for the protection of citizens from terrorist attack they need to be employed even more carefully to ensure that citizens do not become as vulnerable to the police as they do to the terrorist attack. However increased powers of policing maybe necessary to contain the threat of terror and to ensure national security is maintained. Recent cases have showed that where police and other agencies have made a mistake or has been misused their powers there has been a miscarriage of justice. In Dabilola Taylor’s case it was observed how lack of techniques and skills on the part of the investigating officers resulted in bringing to justice who killed Dabilola. In Stephen Lawrence case it was proved that there was racism in the police force. In Confait it was revealed that the conviction based on confession had been made subject to oppression. Jean Charles de Menezes was shot by the Metropolitan Police armed forces who believed he was a terrorist but later found out he was not. Moreover the changes that have been taken place within the statutes also may cause a miscarriage of justice. In Sam Hallam’s case the witness’s evidence was not inconsistent with the earlier evidence. The long standing rule at common law was that where a witness’s testimony in court was inconsistent with a previous statement, it could not be treated as evidence as to the truth of its contents. Juries could not take account of the contents of such statements in reaching their verdict. This rule was changed by section 119 of the Criminal Justice Act 2003 which now allows previous inconsistent statements to be admitted in evidence. Reforms and recommendations have been implemented to reduce the rate of crime and not let an innocent person be guilty of a crime he never committed. The Criminal Procedure and Investigations Act 1996 came into force The CCRC is charged with reviewing convictions and sentences referring them to the appropriate court if it finds a â€Å"real possibility† that the court will judge a conviction unsafe or a sentence excessive. The CCRC covers England Wales and Northern Ireland and receive almost 1000 new applications each year.
